Listing, Trading and Selling of Items
You must be legally able to trade or sell any item that you list on the iTaggit Website as available for trade or sale, and you agree to accurately describe your items and their condition. Items posted for trading or sale may not be (a) stolen; (b) created by any means or method which infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, or which violates any law, statute, ordinance or regulation; or (c) modified in any manner which infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, or which violates any law, statute, ordinance or regulation.
  
Release and Hold Harmless
iTaggit provides a community where users may share information about their collections and transact trades or sells with each other for specific items. While iTaggit provides the tools to share information about items for trade or sale, iTaggit is not involved in the actual transactions between users. Similarly, while iTaggit reserves the right to remove or edit content posted by users, it has no obligation to do so, nor does it regularly review or investigate the accuracy of such posted content. Consequently, iTaggit has no control over the quality or legality of the items being offered for trade or sale, the truth or accuracy of an item's listings, the ability of users to trade, sell, pay for or deliver items, or any other acts or omissions of users on the iTaggit Website. iTaggit cannot ensure that a user will actually complete an agreed-upon trade or sale. In the event that you have a dispute with one or more users, including, without limitation, in connection with any trade or sale, you hereby release iTaggit (and its officers, directors, agents, subsidiaries, affiliates, joint ventures, suppliers and employees) from claims, demands, losses and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. All communications and agreements regarding trading and selling items are between the users themselves and not iTaggit. You acknowledge and agree that the listing of an item for trade or sale does not constitute an offer that can be accepted, that the terms and conditions of any trade or sale must be agreed upon by and between the users and that all such terms and conditions are solely between users. You should conduct whatever investigation and make whatever inquiries that you feel are necessary or appropriate prior to participating in any trade or sale.

Use of Information
In order to allow you to complete a trade or sale, the iTaggit Website will provide you with links and methods to communicate within the site with other users to facilitate online discussions about items being offered for trade or sale. iTaggit grants to you a license to use this information only for communicating with the other user regarding a trade or sale. In all cases, you must give users an opportunity to decline any further contact from you and you must promptly comply with any such request. Under no circumstances may you disclose any information about any trade or sale done with another user through the iTaggit Website to a third party without written consent from the other user or iTaggit.

These terms are in addition to and constitute a part of the Terms of Use Agreement.
